We have been in litigation with Blendtec for several years relating to one of our containers, referred to as the XP container. On Thursday, June 17, a lower court in Utah ruled that Blendtec's patents for its five-sided blending jar are valid. We disagree with the court's ruling as well as the court's earlier summary judgment supporting Blendtec's claim that Vitamix's XP container infringes on the company's patents. We are reviewing our options and intend to avail ourselves of all legal remedies.
The XP container has never been available to household customers, but we thought it important to help clarify the following facts:
- The XP container is NOT a household product; it is a commercial unit representing a small percentage of the commercial side of the business only.
- It is old technology that we have already been replacing with new and improved technology.
- None of our household products are impacted and customers are not affected in any way.
